முஸ்லீம்களான இந்தி நடிகர்கள் இந்துக்களைப் போல ஏன் நிஜ வாழ்க்கையில் நடித்து ஏமாற்ற வேண்டும்?: சுனில் தத், நர்கீஸ் என்ற முஸ்லீம் நடிகையை மணந்து கொண்டதும் முஸ்லஈம் ஆகிவிட்டார். அதாவது, ஒரு முஸ்லீமை திருமணம் செய்து கொள்ள வேண்டும் என்றால், ஆணோ-பெண்ணோ முஸ்லீமாக வேண்டும். அப்பொழுது தான், நிக்காவே செய்து வைப்பார்கள். ஆனால், இந்தி நடிகர்கள் பெரும்பாலோனோர் முஸ்லீம்களாக இருந்தாலும், நிஜ வாழ்க்கையில் இந்துக்கள் போல பெயர்களை வைத்துக் கொண்டு, உடைகள் அணிந்து கொண்டு, மீசை-தாடி இல்லாமல் நடித்து வந்தார்கள். சஞ்சய் தத் குடும்பமும் அவ்வாறே செய்து வந்துள்ளது. சஞ்சய் தத்,, அன்று தனது தந்தையிடம் சொன்னது, “எனது நரம்பு-நாளங்களில் முஸ்லீம் ரத்தம் ஓடுகின்றது, அதனால், மும்பையில் நடப்பதை என்னால் பார்த்துக் கொண்டிருக்க முடியவில்லை”, என்றதாகும். அதாவது, மொரிஸியசிலிருந்து திரும்பி வந்து போலீஸ் நிலையத்தில் இவ்வாறு சொல்கிறான்.
இது புதுவித தாடி-மீசை தோற்றத்தில்.
பிரச்சினை எனும் போது “நான் முஸ்லீம்” அல்லது “முஸ்லீம் என்றதால் தான் என்னை இப்படி செய்கிறார்கள்” என்று குற்றம் செய்தவர்கள் கூறவேண்டியது ஏன்?: முதன் முதலில் இந்த தந்திரத்தைக் கையாண்டவர், முஹம்மது அஸாரத்தூனனென்ற கிரிக்கெட் ஆட்டக்காரர் தான். பிரச்சினை எனும் போது “நான் முஸ்லீம்” அல்லது “முஸ்லீம் என்றதால் தான் என்னை இப்படி செய்கிறார்கள்” என்று குற்றம் செய்தவர்கள் கூறவேண்டிய ரஅசியத்தின் பிண்ணனி இதுதான். அதாவது, இந்திய சட்டங்கள் என்களுக்குப் பொருந்தாது, ஷரீயத் சட்டம் தான் எங்களுக்கு பொருந்தும் என்று சொல்லாமல் சொல்கிறார்கள் போலும்!
அஹா, நெற்றியில் நெடிய நாமம் – ஆமாம் “சாப்ரென் டெரர்” என்று சொல்கிறார்களே, அந்த நிறத்துடன்.

போலீஸார் இன்று கூட சொல்வதென்னவென்றால், சஞ்சய் ஆயுதங்களை மட்டு வைத்திருக்கவில்லை, இதற்கு மேலேயும் செய்துள்ளான் என்பதுதான்[7]. விசாரணையில் பல விஷயங்கள் வெளிவந்துள்ளபோதிலும், சுனில் தத், தன்னுடைய அரசியல் செல்வாக்கு வைத்துக் கொண்டு மறைக்க பாடுபட்டுள்ளார். தான் ஒரு முஸ்லீம் என்றும் சொல்லிக் கொண்டு மதரீதியில் பேசியுள்ளார்[8]மானால், மேலே குறிப்பிட்டுள்ளது போல், இவனோ சொன்னதற்கு மாறாக[9], நெற்றியில் பெரிய நாமத்தைப் போட்டுக் கொண்டு, தனது நண்பனான யுசூப் நல்வாலாவிற்கு அருகில் உட்கார்ந்திருந்தான். மன்சூர் அஹமத்இன் மனைவி சொன்னதாவது[10], “சஞ்சய் பெரிய ஆள், நிறைய பேர்களை தெரியும், பணம் இருக்கிறது. நான் என்ன செய்வது, எனக்கும் பணம் இருந்தால் பெரிய வக்கீலை அமர்த்தியிருப்பேன்”
அட, நாமம் என்ன, என்னவேண்டுமானாலும் செய்வேன் – அமிர்தசர்சில் இந்த கோலம்!

Manzoor Ahmed has been booked under TADA. According to the prosecution, his car was used to pick up a bag containing weapons from Sanjay Dutt’s house. He accompanied Abu Salem to the Dutt residence and from there drove to the house of Zaibunissa Kazi, where the weapons were stored for a few days. Kazi has also been convicted under TADA. Manzoor’s wife Razia Bano, who now takes up tailoring jobs to feed their four children, speaks to Tehelka about the ‘injustice’.

Razia: My husband has nothing to do with the blasts. The car (a Maruti 1000) was in my husband’s name. Abu Salem took him along. My husband went because he wanted to see what kind of houses stars like Sanjay Dutt live in.
According to the police, your husband knew that a bag containing weapons was picked up from Sanjay Dutt’s house.
Only the car was registered in his name and Salem took him along. Manzoor did not know the details.

It was probably the most difficult moment of his life. A moment when he stood on a one-way street. There was nothing, nothing at all that he, Sunil Dutt, could do to save his son Sanjay Dutt from being arrested. The Mumbai Police had found that the actor had acquired deadly AK-56s from Dawood Ibrahim’s brother Anees Ibrahim, and had even had one destroyed after the serial blasts in Bombay that left 257 people dead.
At that moment, there was only one thing Sunil Dutt could do. He picked up the phone and informed the then Police Commissioner AS Samra that his son was returning that night — April 19, 1993 — from Mauritius.
The police picked up Sanjay from the airport, allowed him to sleep on the sofa in one of the officers’ rooms, and at 10am the next day, the then Joint Commissioner of Police (Crime) MN Singh and his deputy Rakesh Maria started the interrogation. Sanjay broke down and narrated the entire story. The same evening, Sunil Dutt and his daughter Priya Dutt met Sanjay in the presence of the police officers. Sunil Dutt was still not ready to believe that his son could have been involved in the blasts conspiracy. Maria told Sanjay to tell his father the truth, and Sanjay conceded that he had been in possession of an assault rifle and some ammunition that he had got from Anees Ibrahim. Sunil Dutt wanted to know the reason why. He was not prepared for the answer: “Because I have Muslim blood in my veins. Thirteen years after he was arrested on charges of acquiring three AK-56 rifles, nine magazines, 450 cartridges and over 20 hand grenades — weapons and explosives associated either with terrorists or counter-insurgency forces — the fate of the filmstar was finally to be decided and Sanjay was nervous. Judge PD Kode walked in to a packed courtroom and first summoned dismissed customs officer SK Thapa to the witness box. As customs officer, Thapa had winked while a cache of arms and explosives was smuggled into the country in 1993 for acts of terrorism. Thapa, the judge said, had been found guilty under different sections of TADA — the Terrorist and Disruptive Activities (Prevention) Act, passed in 1987 to counter acts of terror.

A day after Sanjay’s verdict, two other co-accused, Samir Hingora and Baba Mussa Chauhan, who were part of the chain that delivered weapons to the filmstar’s house in Mumbai’s Pali Hill, were convicted under Sections 5 and 3(3) of TADA — which deal with conspiracy and possession of prohibited arms in city limits — besides being held guilty under different sections of the Arms Act and the Explosives Act. The nature of the charges and the evidence against Chauhan and Sanjay were similar. Chauhan, like Sanjay, had in his possession three AK-56 rifles, some cartridges, magazines and hand grenades. Both Sanjay and Chauhan had the arms delivered to them by the same person — Abu Salem, who after the serial blasts of 1993 escaped the country and carried out criminal activities in India from abroad before being extradited in 2005.
For those present in court, Sanjay’s conviction under TADA seemed a fait accompli. But, in what must have been a huge relief for Sanjay and his battery of lawyers, he was convicted under the Arms Act and is thus now in a position to even seek probation which, if granted, will not see him go to jail at all.
No one knows the anomaly of the judgement better than Maneshinde. On the spycam, he says, “When I will be asked by the Supreme Court why everyone else has got TADA and my client only the Arms Act, I will have no answer.” The statement speaks volumes coming as it does from Sanjay’s own lawyer. Why is the lawyer worried?

Soon after the verbal order on November 28, 2006, eminent lawyer Mahesh Jethmalani, who had also initially defended Sanjay, wrote in Tehelka that the other accused had not had the benefit of what — in Sanjay’s case — he called the “benign judicial eye”. After all, Sanjay was the one who had asked for lethal weapons from his friend and gangster Anees Ibrahim, who along with his brother Dawood, is among the main conspirators of the 1993 blasts. It was Sanjay who had retained one AK-56 and some ammunition while returning two assault rifles, hand grenades and ammunition. In Manzoor’s case, his car had been used to bring back a part of the consignment from Sanjay’s residence. As for Zaibunissa Kazi, she had allowed her house to be used as a transit point. The weapons were meant neither for her nor for Manzoor. The evidence on record shows that their offence was minor when compared to that of Sanjay who kept three AK-56s and hand grenades for close to a week and continued to retain one assault rifle for almost a month after serial blasts rocked Bombay. Apprehending his arrest, Sanjay had the weapons destroyed and, quite unlike Manzoor, he made seven calls to Anees.
THE MYSTERIOUS SANJAY-ANEES PHONE RECORDS
The crucial information that Sanjay had been calling Anees came from the filmstar himself. Says MN Singh, who headed the investigation, “He himself said that he had made the calls. This information came from him and only then did we get the supporting mtnl printouts.” The printouts showed that seven calls had been made to Anees’s number at White House in Dubai. The police also took a sworn affidavit from the Indian Embassy in Dubai saying that the Dubai number to which the calls were made by Sanjay was indeed that of Dawood’s brother. The police also procured the Dubai telephone directory which mentioned the same number against Anees’s name. Only a few of the over 150 accused in the serial blasts case had been in touch with either Dawood or Anees while the blasts conspiracy was being hatched. Sanjay was one of them. All these records were handed over to the CBI. However, when the time came to pin Sanjay down in court, the CBI chose to omit the record related to the telephone calls in its final submission against Sanjay before the TADA court. The prosecution’s submission, a copy of which is with Tehelka, reveals that the CBI has not brought the telephone conversation-related evidence on record. Sources in the CBI said that since the court had not accepted the telephone records as evidence against Sanjay, they decided to delete them from their written submission. Maneshinde also revealed that the calls “have not come on record”.
In what appears to be a dilution, the CBI also failed to press the charge of destruction of evidence against Sanjay in their written submission. Initially, when the Mumbai Police filed the chargesheet, a copy of which is with Tehelka, they had slapped Sanjay with that charge. Nullwala, who destroyed the weapons on Sanjay’s instruction, has been convicted under the Arms Act. Commenting on the disparity, he told Tehelka, “This will always happen… this is nothing new… See this thing… politicians… they do every possible thing… nothing happens to them… Why? It comes in the paper… it comes on the idiot box every single day… but what happens… it’s always people like us, we have to suffer… you know, we are the example for the world…”
Despite the dilution in the CBI’s written submission, there was enough evidence on record. Abu Salem, Baba Mussa Chauhan and Magnum Video owner Samir Hingora — all of whom went to Sanjay’s house to deliver the consignment of arms — have each confirmed the following: one, that he was speaking to Anees when they arrived there; and two — and this is crucial — that Sanjay was eagerly awaiting their arrival. He personally supervised the consignment — aks, hand grenades and ammunition boxes — being taken out from the cavities of the Maruti van in which they had been concealed. He also provided the toolbox to prise out the arms from the places where they had been hidden. Before that, he asked the constable stationed at his mp father’s house to move away from his post. Abu Salem too was not unknown to Sanjay. Both Hingora and Chauhan describe how he “warmly hugged” Salem.

The masterminds of the 1993 bomb blasts in Bombay had a twin agenda. One was to attack the city through a series of explosions, and the other was to arm members of their community well enough to hold their own in communal clashes the blasts were expected to trigger.
For this, assault rifles, pistols and hand grenades were brought from Pakistan and several young men were also taken to Pakistan and given arms training, police officers linked to the investigation recalled after this week’s Supreme Court verdict in the 20-year-old case.
The arms landed at two places in Raigad district and one in Gujarat. The Gujarat consignment was hidden in the cavity of a vehicle and brought to Mumbai by road, driven by Abu Salem, who went on to become a prominent gangster.
Salem and his accomplices needed a quiet place to open the welded cavity and remove the arsenal. The office of Magnum Productions, owned by Hanif Kadawala and Sameer Hingora, on Linking Road in Bandra, was chosen. Dawood Ibrahim’s brother Anees called Hingora and Kadawala and told them to allow Salem to use their compound.
The partners, however, were involved in a dispute with their landlord and did not want to risk catching his attention and suggested using actor Sanjay Dutt’s house instead.
Dutt was contacted and he agreed. Hingora went with Salem after the latter feared he would not be allowed inside by the guards, and the vehicle was taken to Dutt’s garage.
“The Mumbai Police had provided some guards for Sunil and Sanjay Dutt in light of the 1992-93 riots, and the garage was in direct line of sight from where they were stationed. Dutt asked them to move over to another gate, after which the cavity in the vehicle was opened and the arsenal extracted,” said one officer.
“Dutt kept some of it, including three to four hand grenades and the rest was taken away by Salem. Dutt provided the tools for the task as well as duffel bags for loading the weapons,” he added.
Dutt later called Anees and told him he was not comfortable keeping grenades at home as he felt they were unsafe. Mansoor Ahmed, who worked with Salem, went to Dutt’s house and took the grenades away.
Police got to know of Dutt’s involvement after they picked up Hingora and Kadawala. The actor was shooting in Mauritius at the time and the police decided to stay silent until he returned. However, one newspaper reported the development, causing Dutt to panic and call his friend Yusuf Nullwala and ask him to get rid of the weapons.
Nullwala took the guns to a foundry in Marine Lines and tried to destroy them. However, the barrel of the AK-56 rifle could not be destroyed and Nullwala took it to his house, from where it was recovered when police arrested him. Also, a 9 mm pistol could not be destroyed and Nullwala returned it to Dutt. It was recovered from his house when police arrested him.
Dutt later claimed he had retained only one gun for self protection, a claim investigating officers have scoffed at. “It would still be understandable, if not permissible, if Dutt had called up Anees and asked for a 9 mm for personal safety. However, we have evidence of the telephone calls between Dutt and Anees, where the actor asked Anees to take the grenades away, and we had submitted this in court as well,” said another officer.
“While the world thinks there is only an Arms Act case against Dutt, what isn’t widely known is that he had been charged for aiding and abetting the entire crime, with evidence to back the charge up,” he said.
The TADA court, however, acquitted him of the terror charges and this was upheld by the Supreme Court too.

மும்பையில் செய்தியாளர்கள் சந்திப்பின்போது உணர்ச்சிவசப்பட்டு அழுத சஞ்சய் தத்தை தேற்றுகிறார் அவரது சகோதரி பிரியா தத்.
மன்னிப்பு கேட்டு, தண்டனையை ரத்து செய்ய வேண்டுமென்று கோர மாட்டேன்; குறிப்பிட்ட காலத்துக்குள் போலீஸாரிடம் சரணடைவேன் என்று பாலிவுட் நடிகர் சஞ்சய் தத் வியாழக்கிழமை தெரிவித்துள்ளார்.
1993-ம் ஆண்டு மும்பை தொடர் குண்டு வெடிப்பு வழக்கில் உச்ச நீதிமன்றம் கடந்த 21-ம் தேதி தீர்ப்பு வழங்கியது. இதில், முறைகேடாக துப்பாக்கி வைத்திருந்த குற்றச்சாட்டுக்காக சஞ்சய் தத்துக்கு விதிக்கப்பட்ட 6 ஆண்டு சிறைத் தண்டனையை உச்ச நீதிமன்றம் 5 ஆண்டுகளாகக் குறைத்தது.
மேலும், தீர்ப்பு வழங்கிய நாளிலிருந்து நான்கு வார காலங்களுக்குள் சிறைக்குச் செல்ல வேண்டுமென்றும் தனது உத்தரவில் நீதிமன்றம் குறிப்பிட்டது.
இந்த வழக்கில், விசாரணை நீதிமன்றம் வழங்கிய தீர்ப்பைத் தொடர்ந்து 2005-ம் ஆண்டில் ஏற்கெனவே அவர், 18 மாதங்கள் சிறையில் இருந்துள்ளார். பின்னர் ஜாமீனில் வெளிவந்தார்.
இதனால், 5 ஆண்டு சிறை தண்டையில், ஏற்கெனவே சிறையில் இருந்த காலம்போக, மூன்றரை ஆண்டுகள் சஞ்சய் தத் சிறை தண்டனை அனுபவிக்க வேண்டும்.
சஞ்சய் தத்துக்கு மன்னிப்பு வழங்கி, உச்ச நீதிமன்றம் அளித்த தண்டனையை ரத்து செய்ய வேண்டுமென்று நடிகர்கள், சட்ட நிபுணர்கள் உள்ளிட்ட பலர் கருத்து தெரிவித்து வந்தனர்.
இந்த நிலையில், பந்தாரா பகுதியில் உள்ள தனது வீட்டுக்கு முன் செய்தியாளர்களுக்கு அளித்த பேட்டியில் சஞ்சய் தத், மேற்கண்டவாறு தெரிவித்துள்ளார். அவர் மேலும் கூறியது:
எனக்கு மன்னிப்பு அளிக்க வேண்டும் என்று பலர் கருத்து தெரிவித்து வருகின்றனர். கை கூப்பி, நாட்டு மக்களுக்கு நான் கூறுவது என்னவென்றால், எனக்கு மன்னிப்பு வழங்கி தண்டனையை ரத்து செய்ய வேண்டும் என்று கோர மாட்டேன்; அதனால், இது குறித்து எந்த விவாதமும் வேண்டாம்.
போலீஸாரிடம் சரணடைய உச்ச நீதிமன்றம் எனக்கு கால அவகாசம் அளித்துள்ளது. அதற்குள் சரணடைவேன். சரணடைவதற்கு குறுகிய காலம் இருப்பதால், அதற்குள் நான் முடிக்க வேண்டிய பணிகள் நிறைய உள்ளன. எனது குடும்பத்தினருடனும் நேரத்தை செலவிட வேண்டும்.
தீர்ப்பினால், எனது நம்பிக்கை நொறுங்கியுள்ளது. என்னை அமைதியாக இருக்க விட வேண்டும் என்று ஊடகங்களிடமும், மக்களிடமும் கேட்டுக் கொள்கிறேன் என்று தெரிவித்தார்.
இச்சந்திப்பின்போது, சஞ்சய் தத் உணர்ச்சிவசப்பட்டு கண்ணீர் ததும்ப காணப்பட்டார். பேட்டி முடிந்து படப்படிப்புக்காக கிளம்புகையில், நாட்டையும், நாட்டு மக்களையும் நேசிப்பதாக சஞ்சய் தத் கூறினார்.
உச்ச நீதிமன்றத் தீர்ப்புக்குப் பிறகு முதன்முறையாக இப்போதுதான் செய்தியாளர்களை சஞ்சய் தத் சந்தித்துள்ளார். இச்சந்திப்பின்போது அவரது சகோதரியும், காங்கிரஸ் எம்.பி.யுமான பிரியா தத்தும் உடனிருந்தார்.
போலீஸ் கிரி படப்பிடிப்பினை முடித்துத் தருவார்: “போலீஸ் கிரி’ திரைப்படத்தின் படப்பிடிப்பினை சஞ்சய் தத் முடித்துத் தருவார் என்று அத்திரைப்படத்தின் தயாரிப்பாளர் டி.பி.அகர்வால் தெரிவித்துள்ளார்.
திரைப்படம் முடியும் தருவாயில் உள்ளதாகவும், இறுதிக் கட்டப் படப்பிடிப்பு நடந்து வருவதால், குறைந்தது 10 நாள்களாவது அவர் படப்பிடிப்பு தளத்தில் இருக்க வேண்டும் என்றும் அவர் தெரிவித்துள்ளார்.
காங்கிரஸ் தலையிடாது: மன்னிப்பு கோரி விண்ணப்பிக்க மாட்டேன் என்று தத் கூறிய நிலையில், தத் விவகாரம் தொடர்பாக காங்கிரஸ் கட்சி தலையிடாது; எவ்விதக் கருத்தும் கூறாது என்று அக்கட்சியின் செய்தித் தொடர்பாளர் ரஷித் ஆல்வி தெரிவித்தார்.
அதேசமயம், சஞ்சய் தத் விவகாரத்தில் சட்டம் தன் கடைமையைச் செய்ய அனுமதிக்க வேண்டும் என்று பாஜக எம்.பி. பல்வீர் புஞ்ச் தெரிவித்துள்ளார்.
