Village Arbitration
Rapist spared, victim lashed
Sheikh Md Shahidul Islam, B’baria
http://www.thedailystar.net/newDesign/news-details.php?nid=123248
Eight months after being raped, a 16-year-old at Khargor of Kasba upazila in Brahmanbaria had to receive 101 lashes as “punishment”.
A village arbitration found her guilty and issued the 101 lashes fatwa (religious edict) but amazingly left alleged rapist Enamul Mia, 20, untouched.
The arbitration also fined the victim’s father Tk 1,000 and issued another fatwa that her family would be forced into isolation if he failed to pay up.
Village matbar (local leader) Delwar Hossain alias Ullashi executed the durra (lashes) on January 17.
Family sources said Enamul Mia of Gabbari used to eve-tease the girl on her way to Sathgram Advocate Haroon-or-Rashid High School. He raped her April last year. Fearing the shame, the girl did not disclose the incident.
The girl’s family had married her off to a man of neighbouring Ghatiara village but after a month into the marriage medical test discovered she was seven months pregnant.
She was divorced and she had to live at her father’s place after an abortion. Following her return, a group of so-called matbars led by Manik Mia declared that her family is to be isolated until punished.
On January 17, the influential group arranged the arbitration at the yard of the victim.
At one stage of the inhuman torture, the girl collapsed and fainted. She regained her sense after two hours.
Ullashi presided over the arbitration while Wahid Mia, Basu Mia, Manik Mia, Shahjahan Mia, Dulal Mia, Maulana Md Kawser Mia, Imam of Gupinathpur Baro Mosque, Maulana Md Ishaque Mia, Imam of Khargor Jame Mosque, and a few others played key roles.
“Enamul has spoiled my life. I want justice,” said the girl as tears rolled down from her eyes.
Talking to The Daily Star, neighbours spoke in favour of the girl and blamed Enamul. They did not dare to say anything against the so-called village arbitration.
The girl’s father said members of the influential group are now keeping a watch on them so that they could not move or seek legal action.
Wahid Mia said they executed the 101 lashes on the girl following the religious edict and they did not call Enamul during the arbitration as he belongs to another village.
A team of human rights activists led by advocate Mili Chowdhury visited the spot.
Their organisation will help the victim file separate cases against the culprits, Mili said.
Kasba Police Station Officer-in-Charge (OC) Md Jahirul Islam Khan said they would take appropriate action if the victim files a case in this regard.
Three women were whipped as a result of fatwas in the district during the last six months.

A Saudi judge has ordered a woman should be jailed for a year and receive 100 lashes after she was gang-raped, it was claimed last night.
The 23-year-old woman, who became pregnant after her ordeal, was reportedly assaulted after accepting a lift from a man.
He took her to a house to the east of the city of Jeddah where she was attacked by him and four of his friends throughout the night.

A judge in the Saudi city of Jeddah, pictured, ruled that the woman was guilty of adultery and should be jailed for a year
She later discovered she was pregnant and made a desperate attempt to get an abortion at the King Fahd Hospital for Armed Forces.
According to the Saudi Gazette, she eventually ‘confessed’ to having ‘forced intercourse’ with her attackers and was brought before a judge at the District Court in Jeddah.
He ruled she had committed adultery – despite not even being married – and handed down a year’s prison sentence, which she will serve in a prison just outside the city.
She is still pregnant and will be flogged once she has had the child.
The Saudi Arabian legal system practices a strict form of medieval law. Women have very few rights and are not even allowed to drive.
They are also banned from going out in public in the company of men other than male relatives.

Riyadh: rape victim might be lashed 100 times
SAUDI ARABIA – PHILIPPINES 01/22/2010 15:57
http://www.asianews.it/news-en/Riyadh:-rape-victim-might-be-lashed-100-times-17425.html
Woman becomes pregnant after being raped. As a result of the harsh prison conditions, she lost her child. Under Islamic law, extra-marital relations are forbidden and for the law any sexual violence involved makes no difference
Riyadh (AsiaNews/Agencies) – A woman jailed after being raped could be lashed 100 times. Camille, an invented name, is a 35- year-old immigrant from the Philippines who has been in a Saudi jail since September 2009. As a result of her rape, she became pregnant, but miscarried because of harsh prison life.
Under Saudi Arabia’s rigid application of Sharia or Islamic law, sexual relations outside of wedlock are strictly forbidden, irrespective of whether the woman is consenting or not. In fact, rape is punished in accordance with rules laid down in the Qur‘an.
The woman’s mother told her story in an interview with GMANews.Tv. Last spring, Camille went to Saudi Arabia to work in a dental clinic to support her 5-, 14- and 15-year-old children. In August, a co-worker from Bangladesh raped her.
Knowing that extra-marital relations are punishable under Saudi law, she did not go to the police to file charges, and tried instead to leave the country and return to the Philippines.
During a routine medical examination that expatriates must undergo before leaving, doctors found that she was pregnant. An arrest warrant was issued against her and on 11 September 2009, she was locked up in Hafer al Baten Central Jail.
Because of the generally harsh conditions in Saudi prisons, Camille miscarried last December.
According to her mother, she is scheduled to go before the judges who could impose 100 lashes.

This is only social aberration and Islam has to rethink about such punishments.

Oh, my God!
You say that it is simply, “This is only social aberration………..”, then, I may have to enjoy with “Minor Kunju” joke, as pointed out by another friend somewhere here in the http://www.islamindia.wordpress.com
You also add to assert that, “……. and Islam has to rethink about such punishments”!
Do not you think that here you imply that Islam is responsible?
Otherwise, why “…………Islam has to rethink about such punishments”?
